律師服務收費標準
一、計時收費 　　
（一）適用范圍：全部律師服務事項 　　
（二）收費標準：200－3000元／小時 　　
（三）上下浮動幅度：20％
二、計件收費 　　
（一）適用范圍：各類訴訟、仲裁和案件執行法律事務 　　
（二）收費標準： 　　
1、刑事： 　　
（1）偵查階段：2000－5000元 　　
（2）審查起訴階段：5000－15000元 　　
（3）審判階段：6000－30000元 　　
對疑難重大復雜案件、集團犯罪案件可在不高于上列標準的1.5倍的范圍內協商確定收費。 　　刑事自訴、擔任被害人代理人的按上列標準執行。
2、民事、商事、行政訴訟： 　　
（1）不涉及財產：5000－20000元 　　
（2）涉及財產：在收取基礎費用5000－10000元的基礎上再按其爭議標的額分段按比例累加計算收取： 　　5萬元（含5萬元）以下：免加收 　　
5萬－10萬元（含10萬元）：8％ 　　
10萬－50萬元（含50萬元）：5％ 　　
50萬－100萬元（含100萬元）：4％ 　　
100萬－500萬元（含500萬元）：3％

3、說明： 　　
（1）上列各項收費標準和比例是辦理訴訟案件一個審級或仲裁案件的收費標準。未辦一審而辦二審的，按一審標準收費；曾辦一審再辦二審的或曾辦一審或二審，再辦發回重審、再審申請或確定再審案件的，按一審標準減半收費；涉及仲裁的案件，曾代理仲裁的，訴訟一審或二審階段按仲裁標準減半收費。 刑事附帶民事，其民事部分按一審標準減半收取。 　　

（2）辦理涉及財產關系的民商事案件亦可采取風險收費，風險收費的最高收費標準或總額，不得超過爭議利益的30％。 　　
三、協商收費 　　
（一）適用范圍： 　　除訴訟、仲裁、執行案件外的其它各類非訴訟法律事務 　　
（二）收費標準：由律師事務所與委托人協商。



The Statutory Standards for Lawyer’s Fees
1. Hourly Rate
1.1 Applicable Scope: all legal services
1.2 Standard for Charges: 200RMB---3000RMB an hour
1.3 Floating Extent of Charges: 20%

2. Charges on the Claim Amount Basis
2.1 Applicable Scope: various lawsuits, arbitrations and other legal issues concerning the execution of a case.
2.2 Standard for Charges:
2.2.1 In Criminal Cases
2.2.1.1 Inquisitional Phase: 2000RMB---5000RMB
2.2.1.2 Examination and Prosecuting Phases: 5000RMB---15000RMB
2.2.1.3 Trial Phase: 6000RMB---30000RMB
Should the lawyer’s fees not exceed 1.5 times of the statutory standards, negotiated fees are permissive as to those hard, complicated and important cases as well as group criminal cases.
The fees for private prosecution and the attorney of the victim shall be also executed abide by the above standards.
2.2.2 In Civil, Commercial and Administrative Cases:
2.2.2.1 Property not involved: 5000RMB---20000RMB
2.2.2.2 Property involved: Lawyer’s fees are, in addition to the basic fees from 5000RMB to 10000RMB, calculated as a percentage of the of the subject matter as follows:
50,000(including 50,000) or below: free from more charges
50,000 to 100,000(including 100,000): 8%
100,000 to 500,000(including 500,000): 5%
500,000 to 1,000,000(including 1,000,000): 4%
1,000,000 to 5,000,000(including 5,000,000): 3%
5,000,000 to 10,000,000(including10, 000,000): 2%
10,000,000 to 50,000,000(including50, 000,000): 1%
50,000,000 or above: 0.5%
2.2.2.3 Floating Extent of Charges: 20%
2.2.3 Instructions
2.2.3.1 The aforesaid standards and proportions for lawyer’s fees apply to one trial level of a case and arbitrations. Lawyers who only appeal on behalf of the clients shall charge according to the standards aforementioned. In the event the lawyers on behalf of the clients: 1) have appeared in the trial of the first instance and now appeal for the clients, or 2) have appeared in either the trial of the first instance or the appeal, and then now work for retrial cases, retrial applications or confirmation of retrial cases, they shall charge half of the fees in accordance with the aforesaid standards. Lawyers shall charge half of the fees pursuant to the aforesaid standards for any case involving arbitrations in the trial of the first instance or the appeal.
2.2.3.2 The venture fees are applicable in civil and commercial cases concerning property relationship. The highest charges shall not exceed 30% of the subject matter.

3. Negotiated Fee
3.1 Applicable Scope: non-litigious affairs other than litigations, arbitrations and execution of cases.
3.2 Standards of Charges: negotiated fees.
